In our opinion, every time we do agile, we do some elements of what we used to call Waterfall.
There are many examples. Today we limit ourselves to dealing with Contracts (fixed scope-date-budget) and implied contracts (there is no contract per se, but there are understood scope-date-budget constraints).

- Start the discussion early
- A contract means “I don’t trust you”. And you know: caveat emptor. This is NORMAL at first.
- Give them your best guess of when this Release will be delivered
- Re-plan every Sprint (quickly)
- Help your customer understand that change happens; and so the date is just a guess
- Update the customer frequently
- Tell management if you need something (and why)
- Show management (and the customer) that you are always improving
- 80-20
- Use BVPs. Learn!
- Discuss the trade-offs every Sprint.
- Pull in the Business Side & Customers
- First things first. Understand prioritization better: ours and theirs
- Have a strategy for learning. Expect it to change.
There is no magic. If your counterpart does not accept that change happens, it can still be ugly. If you (the Team) are not doing its best to learn and improve, then the customer or managers have a right to worry that “things are too loosey-goosey”.
